# 13 - ISO 45001:2015 - Leadership and workers participation (Clause 5)

# 13
ISO 45001:2015 - Leadership and workers participation (Clause 5)

Requirements in this section (sub-clauses 5.1 to 5.3) are meant for the top management. ISO 45001:2018 standard requires proactive role of the top management and also consultation and participation of workers.

Top management = Individual or group of people, at the highest level in the organization, who directs and controls the organization.

Top management roles and responsibility include:
- Delegation of authority,
- Provision of resources,
- Ultimate responsibility for the OH&S management system,

(5.1) Leadership and commitment

Requirements for the top management

Demonstrate - Leadership and commitment for with respect to OH&S management system

Take overall responsibility and accountability - (i) For the prevention of work-related injury and ill health, and (ii) Provision of safe and healthy workplaces and activities

Ensure - (i) Establishment of OH&S policy and related objectives, (ii) Established OH&S policy and related objectives are compatible with the strategic direction of the organization, (iii) Integration of OH&S management system requirements into the organization's business processes (those activities that are core to the purposes of the organization's existence), (iv) Availability of resources needed to establish, implement, maintain and improve the OH&S management system, (v) OH&S management system achieves its intended results, (vi) Continual improvement, (vii) Establishment and implementation of processes for consultation and participation of workers

Communicate - (i) Importance of effective OH&S management system, (ii) Importance of conforming to the OH&S management system requirements

Promote - Continual improvement

Develop, lead and promote - Supporting culture in the organization that supports OH&S management

Protect - Workers from reprisals when reporting incidents, hazards, risks and opportunities.

Support - Establishment and functioning of health and safety committees.

Comments

Role of the top management is important and relevant in implementing ISO 45001:2018 Occupational health and safety management system. Through leadership and actions, the top management is able to create an environment in the organization where people are fully involved in their activities as per their defined responsibility and authority in the organization. They should also be able to create a proactive internal environment in the organization in which an occupational health and safety management system can operate effectively and the people are fully involved in achieving the organization's OH&S objectives.

Elizabeth Gasiorowski-Denis says, "Top management must take an active role, promote a positive culture and communicate what needs to be done and, more to the point, why it's important." (ISOfocus #127)

(5.2) OH&S policy

Requirements for the top management

Establish, implement and maintain - An OH&S policy

Ensure OH&S policy to include commitment - (i) to provide safe and healthy working conditions for the prevention of work-related injury and ill health, (ii) to fulfill legal requirements and other requirements, (iii) to eliminate hazards and reduce OH&S risks, (iv) to continual improvement of the OH&S management system, (v) to consultation and participation of workers and workers representatives (if exist).

Ensure OH&S policy to provide - Framework for setting the OH&S objectives

Other requirements

Make available - (i) OH&S policy as documented information, (ii) OH&S policy to interested parties, as appropriate.

Communicate - OH&S policy within the organization

Ensure - OH&S policy to be relevant and appropriate

Comments

OH&S policy is an important part of the OH&S management system. It should be written in a plain and simple language, easy to understand and implement. An OH&S policy is a formal expression by the top management of the organization regarding intentions and directions to prevent work-related injury and ill health to workers and to provide safe and healthy workplaces. Thus an OH&S policy simply states how an organization, its employees, and others are expected to behave when they are on organization property or performing organization related activities.

In developing an organization's OH&S policy, consider consistency and coordination of the OH&S policy with other policies of the organization, such as QMS policy, EMS policy, etc.

(5.3) Organizational roles, responsibilities and authorities

Requirements for the top management

Ensure - Assigning and communicating the responsibilities and authorities for relevant roles within the OH&S management system at all levels within the organization,

Assign responsibility and authority for - (i) Ensuring OH&S management system conforms to the requirements of ISO 45001:2018 standard, (ii) Reporting on the performance of the OH&S management system to top management.

Requirements for workers at each level of the organization - Assume responsibility for those aspects of the OH&S management system over which the workers have control.

Comments

The top management of the organization needs to ensure that everyone in the organization know and understand responsibilities (what they need to do) and their authorities (what they are allowed to do). ISO 45001:2018 standard does not stipulate the method to be used for communication of responsibilities and authorities, however, there are several ways of communication, such as, organizational structure diagram, functional description, job description, flow chart, description in procedures, etc.

(5.4) Consultation and participation of workers

Requirements

Establish, implement and maintain - Process / processes for consultation and participation of workers at all applicable levels and functions, and workers' representatives (if any), in the development, planning, implementation, evaluation of performance and actions for improvement of OH&S management system.

Provide - (i) Mechanisms (such as worker representation), time, training and resources necessary for consultation and participation, (ii) Timely access to clear, understandable and relevant information about the OH&S management system

Determine and remove, and if cannot be removed then minimize - Obstacles or barriers to participation

Emphasize the consultation of non-managerial workers on - (i) Determining the needs and expectations of interested parties, (ii) Establishing the OH&S policy, (iii) Assigning organizational roles, responsibilities and authorities, as applicable, (iv) Determining the ways to fulfill legal requirements and other requirements, (v) Establishing OH&S objectives and planning to achieve them, (vi) Determining applicable controls for outsourcing, procurement and contractors, (vii) Determining what to monitor, measure and evaluate, (viii) Planning, establishing, implementing and maintaining an audit programme, (ix) Ensuring continual improvement.

Emphasize the participation of non-managerial workers in - (i) Determining the mechanisms for consultation and participation, (ii) Identifying hazards, (iii) Assessing risks and opportunities, (iv) Determining actions to eliminate hazards and reduce OH&S risks, (v) Determining competence requirements, training needs, training and evaluating training, (vi) Determining communication needs and its ways, (vii) Determining control measures, their effective implementation and use. (viii) Investigating incidents and nonconformities, (ix) Determining corrective actions.

Comments

Elizabeth Gasiorowski-Denis says, "Many employers recognize that successfully managing OH&S risk not only prevents injury, ill-health and death, it supports livelihoods, businesses and communities. And the system approach used by ISO 45001 can help more organizations achieve this. .... In order for an OH&S to be strong and healthy, everyone in the organization must feel that he or she shares some responsibility for maintaining a safe environment. This includes employees all the way up to executives. Company-wide engagement is one of the key benefits of ISO 45001. The new standard recognizes the value of worker consultation in the development of better OH&S practices and places greater emphasis on employees actively participating in the development, planning, implementation and continual improvement of the OH&S management system." (ISOfocus #127)

Consultation and participation of workers, including workers' representation, can be a key factors of success for an OH&S management system. Established processes of the organization should encourage consultation and participation of workers, including workers' representation.

Process for formal consulting or discussing should be established and encouraged in the organization. There should be no fear among workers for providing any suggestion. Consultation indicates a two-way communication among management and its employees that involves dialogue and exchange of suggestions and thoughts. Timely provision of information is an important aspect for consultation and participation of workers. Involving workers though communication and participation lead to good decision making on OH&S planning, implementing and performance. With an active participation of workers, feedback on OH&S management system can be obtained resulting improvement in OH&S management system. The organization should take all possible steps to encourage workers to report matters of hazardous situations, so that the organization is able to take suitable corrective and preventive measures.

# 12 - Format for determining external and internal issues for OH&S Management System

# 12
Format for determining external and internal issues for OH&S Management System

- Keshav Ram Singhal

# 11 - ISO 45001:2015 - Context of the organization (Clause 4)

# 11
ISO 45001:2015 - Context of the organization (Clause 4)

(4.1) Understanding the organization and its context

Requirements

Determine: External and internal issues: (i) relevant to organization's purpose, (ii) effecting organization's ability to achieve organization's OH&S management intended outcomes.

Comments

- Issues (external and internal) can be positive or negative.
- Issues can include conditions, characteristics or changing circumstances that can affect the occupational health and safety management system of the organization.
- No specific methodology, for determining external and internal issues, is mentioned in the standard. It is for the organization to apply its own suitable method. One such method to determine the internal and external issues may consists following steps - (i) The top management of the organization should constitute a team of identified persons, who are well-versed with organization and its processes, (ii) The team members should think individually as well as collectively and identify positive/negative factors and conditions that are relevant and that can affect achievement of organization's goals/objectives, (iii) All such identified issues should be summed-up.
- The author of this literature has designed formats for determining the external and internal issues. Format will be posted in the forthcoming post.

(4.2) Understanding the needs and expectations of workers and other interested parties

Requirements

Determine: (i) Other interested parties that are relevant to organization's OH&S management, (ii) requirements (needs and expectations) of workers, (iii) requirements (needs and expectations) of other interested parties, (iv) which determined requirements (needs and expectations) are or could become legal or other requirements.

Comments

- In addition to workers, other interested parties can include legal and regulatory authorities that can be local, state, national or international authorities (such as Municipal Corporation, Government health department, Government Fire Brigade, State Government bodies, Central government bodies etc.), parent organization, suppliers, contractors, subcontractors, workers' or trade union representatives, trade unions, employers' organizations, owners, shareholders, customers, clients, visitors, local community, neighbours, general public, medical services, other community services, media, academia, business organizations and associations, NGOs etc.
- Needs and expectations (requirements) of legal and regulatory authorities are mandatory, so it is necessary to determine all such requirements.
- No specific methodology, for determining the needs and expectations (requirements) of workers and interested parties, is mentioned in the standard. It is for the organization to apply its own suitable method. One such method to determine the internal and external issues may consists following steps - (i) The top management of the organization should constitute a team of identified persons, who are well-versed with organization and its processes, (ii) The team members should think individually as well as collectively and identify relevant interested parties and their needs and expectations. (iii) All such identified interested parties and their requirements should be summed-up.

(4.3) Determining the scope of the OH&S management system

Requirements

Consider: Determined external and internal issues

Take into account: (i) Determined requirements of workers and other interested parties, and (ii) planned / performed work-related activities.

Determine: Scope (boundaries and applicability) of the organization's OH&S management system

OH&S MS must include: Activities, products and services that are under organization's control or can influence / impact the organization's OH&S performance.

Maintain, retain and make available documented information: Determined scope.

Comments

Scope = boundaries and applicability of the management system

There is freedom for an organization to determine and define the scope of its OH&S management system. The scope of the OH&S management system may include the whole organization or a specific department or specific departments. While determining the scope of organization's OH&S management system for a specific department or specific departments, it should be ensured that such specific department's or departments' top management should have its own functions, responsibilities and authorities for establishing an OH&S management system.

The scope of the OH&S management system must include activities, products and services that have or can impact the organization's OH&S performance. The scope of the OH&S management system should not exclude activities, products and services to escape or avoid organization's legal requirements and other requirements.

The scope is an accurate and demonstrative description of the organization's processes that are included within the organization's OH&S management system boundaries. The scope should not mislead or misguide interested parties.

While determining the scope of an organization's OH&S management system, please ensure to have all activities included in the scope that have or may create health and/or safety hazards. You may exclude specific activity or function from the scope that does not have or may not create any health and safety hazards.

(4.4) OH&S management system

Requirements

Establish, implement, maintain and continually improve: OH&S management system including processes and their interactions as per ISO 45001:2018 standard's requirements.

Comments

The standard requires the organization to establish, implement, maintain and continually improve the organization's OH&S management system, including the processes needed and their interactions. Requirements of ISO 45001:2018 OH&S standard should be considered and fulfilled while establishing, implementing, maintaining and continually improving the occupational health and safety management system in the organization.

The organization's OH&S management system should be aligned and united with business processes of the organization to ensure that OH&S performance is in line with OH&S policy of the organization.

ISO 45001:2018 standard can be implemented for a specific part or parts of an organization subject to the scope of the organization's OH&S management system.

Elizabeth Gasiorowski-Denis says, "In order for an OH&S to be strong and healthy, everyone in the organization must feel that he or she shares some responsibility for maintaining a safe environment. This includes employees all the way up to executives." (ISOfocus #127)

# 08 - ISO 45001:2018 and PDCA

# 08
ISO 45001:2018 and PDCA

The approach applied in ISO 45001:2018 OH&SMS standard is founded on the concept of PDCA (Plan-Do-Check-Act). The standard incorporates the PDCA concept in its framework. The PDCA concept is a methodology that includes:

Plan - Ascertain, establish and evaluate: (i) OH&S risks and opportunities, (ii) other risks and opportunities, ascertain and establish the following to get the desired results according to OH&S policy of the organization : (i) OH&S objectives, and (ii) necessary processes.

Do - Implementation of established (planned) processes.

Check - (i) Monitoring and measuring of processes and activities carried out in the organization with regard to OH&S policy and OH&S objectives, and (ii) Reporting the outcome.

Act - Take actions to continually improve OH&S performance so that desired results are achieved.

If we compare ISO 45001:2018 standard with OHSAS 18001:2007 standard, we find that ISO 45001:2018 standard marks a moves away from the POPMAR (policy, organizing, planning, measuring, auditing and review) model to PDCA (plan, do, check, act) model. This brings the standard in line with most international standards (such as ISO 9001:2015, ISO 14001:2015 and other standards) that apply PDCA concept.

Relationship between PDCA and the framework in ISO 45001:2018 is shown in figure 1 of the standard. Please refer to the standard document for reference.

# 06 - What are the factors that may help effective implementation of ISO 45001:2018 OH&S management system standard in an organization? What is the assurance of successful implementation of ISO 45001:2018 standard?

# 06
What are the factors that may help effective implementation of ISO 45001:2018 OH&S management system standard in an organization? What is the assurance of successful implementation of ISO 45001:2018 standard?

Organizations need to protect its people, its reputation and its future. As such, occupational health and safety has to be a major business concern, beyond being a legal duty. Managing occupational health and safety (OH&S) management system effectively, systematically and in a sustained way ensures that the highest levels of occupational health and safety (OH&S) performance are a key objective.

It is a complex, long term and operational decision for an organization to implement ISO 45001:2015 OH&S management system. Top management leadership role and commitment and participation from all levels and functions of the organization make the implementation in a proper way.

Some of the key factors required, for the effective implementation and maintenance of ISO 45001:2018 OH&S management system standard, are as under:

- Top management leadership role that include its commitment, responsibilities, accountability for implementing the standard requirements. Top management should develop, lead and promote a culture in the organization that pave the way for implementing the standard's requirements.
- Appropriate communication (internal as well as external) processes make the implementation smooth.
- Involvement, including consultation and participation, of workers and their representatives (if exist) for implementing the standard's requirements. Occupational health and safety management is everyone’s business. It encompasses everyone in an organization, from the highest level down; including temporary as well as permanent workers; and visitors and neighbours. It also has to be across all departments and divisions in an organization, to ensure that they develop collaborative and engaging relationships between their functions.
- Allocation of necessary resources, such as, human resources, infrastructure etc.
- Occupational health and safety policy of the organization that are in line with the organization's objectives and direction.
- Effective steps and actions should be taken to (i) establish and discover hazards, (ii) control risks, and (iii) take advantages that are associated with occupational health and safety of the organization.
- Necessary steps and actions should be taken to carry out regular performance evaluation and monitoring of the occupational health and safety management system as per ISO 45001:2018 standard.
- Necessary steps and actions should be taken to integrate the organization's occupational health and safety management system into the organization's business actions.
- Organization's occupational health and safety objectives should (i) be in line with the organization's occupational health and safety policy, (ii) take into account organizations hazards and occupational health and safety risks and opportunities.
- Necessary steps should be taken to comply legal requirements and other requirements to which organization subscribes.

Successful implementation of ISO 45001:2018 standard in the organization provides assurance to people, including its workers and interested parties, that there is effective occupational health and safety management system in the organization to (i) eliminate hazards, (ii) minimize occupational health and safety risks by taking effective preventive and protective actions. It ought be understood that adoption or selection of ISO 45001:2018 does not itself guarantee (i) preventing work-related injury and ill health to people working in the organization, (ii) providing safe and healthy workplaces, and (iii) improved occupational health and safety performance. The Success of an organization's occupational health and safety management system also depends on a number of factors (such as: context of the organization, scope of the occupational health and safety management system of the organization and the nature of organization's activities and related risks associated with the occupational health and safety) for which documented information and resources needed are essential.
